Product Use

The use and intended application of the Prima Pack products (the “Products”) is as listed on the Prima Pack website www.primamats.com (the “Website”). Any other use of the Products, any improper use of the Products or any use of the Products in a manner other than as listed by Prima Pack could result in damage to the Products or injury.  Prima Pack specifically states that the Products are not to be used for, including but not limited to, the following purposes:

• acting as a bridge
• over a trench or manhole
• in any structural manner.

Prima Pack accepts no responsibility for any damage or liability arising from the use of the Products by the User in any manner other than as listed on the Website.

Warranty Statement

Prima Pack warrants to the original User only that the Products are free from defect in material and workmanship at the Date of Purchase by the User and shall, under normal use and service, remain free from defects in material and workmanship (the “Warranty”) for a maximum period of Two (2) years from the Date of Purchase of the Products (the “Warranty Period”). For the purpose hereof, the Date of Purchase of the Products is the date that Prima Pack either (i) delivers the User’s Order to the carrier to be shipped to the User or (ii) if the User picks-up the Order, the date the Order is picked-up by or on behalf of the User from Prima Pack.

This Warranty becomes null and void if damage to the Products is caused by: (i) misuse or abuse of the Products and specifically and use of the Products for a purpose other than as provided for on the Website or in the ; (ii)  accident causing damage to the Products; (iii) the attachment of any unauthorized accessory to the Products; (iv) alteration of the Products in any manner; (v) improper installation of the Products; (vi) exposure of the Products to harsh weather, debris and other hazards and/or chemicals; (vii) lack of proper maintenance; or (vii) unauthorized repairs. This Warranty also becomes null and void if the Product is damaged by any other condition that is beyond the control of Prima Pack.

IN ALL CASES, PRIMA PACK SHALL NOT BE RESPONSIBLE FOR ANY TYPE OF INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES. ALL OTHER WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICUALR PURPOSE AND THE IMPLIED WARRANTY OF MERCHANTABILITY, ARE EXCLUDED.

Warranty Remedy and Procedure

In the event of the defect of the Product subject to the Warranty within the Warranty Period (a “Warranty Claim”), Prima Pack will, upon satisfactory proof of such Warranty Claim, replace the damaged Products. In order to provide satisfactory proof of the Warranty Claim, the User must submit the following:

• Proof of Purchase from Prima Pack by User
• Photograph depicting the defect Products
• Photograph depicting the use of the Products by the User (the Product must remain in place where defect occurred)

Upon satisfactory proof of Warranty Claim, Prima Pack will arrange for delivery of replacement Products to the original point of purchase. The foregoing is the sole and entire remedy for a Warranty Claim.
